No, you cannot legally turn off, disable, or remove a speed limiter on a commercial vehicle in the UK. Speed limiters are a legal requirement for HGVs over 3.5 tonnes and buses/coaches over 5 tonnes, and any attempt to disable or circumvent one is a criminal offence that can result in an unlimited fine, vehicle prohibition, loss of your operator’s licence, and up to two years’ imprisonment.

This article explains why speed limiters cannot simply be “switched off,” how enforcement agencies detect tampering, and what the real-world consequences look like for drivers and operators who try.

Why You Cannot Just Turn It Off

Unlike some driver-assist features in passenger cars, a commercial vehicle speed limiter is not a convenience setting — it is a legally mandated safety device. There is no button, menu, or ECU setting that allows you to disable it, and the system is specifically designed to resist tampering.

A properly installed speed limiter works by interfering with the fuel supply or electronic throttle signal once the vehicle reaches its set speed (56 mph for HGVs, 62 mph for buses and coaches). The system is integrated into the vehicle’s engine management and cannot be “turned off” without physically modifying the vehicle’s electronics or mechanically bypassing the device.

The distinction matters: a brief kickdown for emergency overtaking is a designed safety feature, whilst permanently disabling the system is illegal tampering.

How Tampering Is Detected

Some operators and drivers assume that disabling a speed limiter is difficult to detect. In reality, modern enforcement techniques make tampering increasingly easy to identify. The DVSA and authorised testing stations use several methods:

Roller Speed Testing

During annual MOT tests and targeted roadside checks, the vehicle is placed on a roller dynamometer. The engine is run under load, and the point at which the speed limiter activates is recorded. If the vehicle exceeds its set speed (or no activation is detected at all), the vehicle fails immediately.

Tamper-Evident Seals

All compliant speed limiter installations include tamper-evident seals on critical connections and the device itself. These seals are marked with the installer’s identification and are designed to show visible damage if disturbed. Broken or missing seals are treated as evidence of potential tampering and will trigger further investigation.

ECU Data Analysis

Modern vehicles log extensive data in their electronic control units. DVSA enforcement officers can download this data during investigations, revealing:

  • Periods where the speed limiter was inactive despite high vehicle speeds
  • Modifications to engine management parameters
  • Aftermarket devices connected to the vehicle’s CAN bus
  • Anomalies in throttle position versus vehicle speed data

Tachograph Cross-Referencing

Digital tachograph data records vehicle speed independently of the speedometer and speed limiter. If tachograph data shows sustained speeds above the limiter’s set point, this is strong evidence that the limiter has been tampered with or is non-functional.

Physical Inspection

Experienced enforcement officers know what a compliant installation looks like. Non-standard wiring, missing components, additional relay boxes, or modified connectors are all red flags that prompt deeper investigation.

What Happens If You Get Caught

The consequences of speed limiter tampering are severe and escalate depending on the circumstances:

For the Driver

  • Fixed penalty notice of up to £300 for driving a non-compliant vehicle
  • Criminal prosecution under Section 41A of the Road Traffic Act 1988 for using a vehicle in a dangerous condition
  • Driving disqualification — the court may impose penalty points or disqualification
  • Personal liability — the driver can be prosecuted even if the operator instructed them to drive the vehicle

For the Operator

  • Immediate vehicle prohibition — the vehicle is taken off the road until the limiter is repaired, recalibrated, and re-inspected
  • Traffic Commissioner referral — all prohibition notices are reported, and tampering cases are treated as the most serious category of non-compliance
  • Public inquiry — the operator may be required to attend a public hearing
  • O-licence revocation — deliberate tampering is one of the offences most likely to result in loss of your operator’s licence
  • Unlimited fine if prosecuted on indictment
  • Up to two years’ imprisonment for the most serious offences, particularly where tampering contributed to an accident or death

In the Event of an Accident

If a vehicle is involved in an accident and the speed limiter is found to have been tampered with, the consequences multiply:

  • Insurance claim rejection — insurers will almost certainly refuse to cover a claim where the vehicle was illegally modified
  • Corporate manslaughter charges — if the accident results in a death, both the operator and responsible individuals can face corporate manslaughter prosecution
  • Civil liability — the operator and driver face unlimited personal liability for damages

Common Myths About Disabling Speed Limiters

”My mechanic can do it and nobody will know”

Modern ECU data logging and tachograph cross-referencing make undetected tampering increasingly difficult. Even if the physical modification is well-hidden, the data trail often reveals the interference.

”I only need it for the MOT”

The speed limiter must be functional at all times the vehicle is on a public road, not just during the annual test. DVSA roadside checks are unannounced and can happen anywhere.

”Other drivers do it and nothing happens”

Enforcement is risk-based and targeted. The DVSA uses intelligence, ANPR data, and tachograph analysis to identify non-compliant operators. When they do catch tampering, the consequences are disproportionately severe compared to a simple maintenance failure.
