The International Standard: ECE Regulation 89
ECE Regulation 89 (R89) is the international type-approval standard for speed limiting devices. Issued by the United Nations Economic Commission for Europe (UNECE), R89 defines the technical requirements that a speed limiter must meet to be legally fitted to a commercial vehicle.
What R89 Requires
- The speed limiter must prevent the vehicle from exceeding a set maximum speed
- Speed accuracy must be within ± 5% of the set speed under all conditions
- The device must be tamper-resistant with sealed calibration
- The system must not interfere with other vehicle safety systems
- The manufacturer must obtain type-approval from a recognised testing authority (e.g. UTAC, TÜV, VCA)
Which Vehicles Need R89 Speed Limiters
Under most national implementations of R89:
- Category M3 — Buses and coaches with more than 8 passenger seats: limited to 100 km/h
- Category N2 — Goods vehicles 3.5–12 tonnes: limited to 90 km/h
- Category N3 — Goods vehicles over 12 tonnes: limited to 90 km/h

United Kingdom
Current Regulations
The UK implements speed limiter requirements through the Road Vehicles (Construction and Use) Regulations 1986 (as amended). Enforcement is by the DVSA (Driver and Vehicle Standards Agency).

- DVSA roadside checks can test speed limiter calibration on the spot

- Speed limiter plates must be displayed showing the set speed and calibration date
Post-Brexit Position
Following Brexit, the UK retained ECE R89 as the accepted type-approval standard. Speed limiters approved under R89 by any UNECE-recognised authority (UTAC, TÜV, VCA) remain fully legal in the UK. There is no separate UK-only approval requirement.
European Union
EU Framework
The EU mandates speed limiters through Directive 2002/85/EC, which requires all member states to enforce speed limiter fitment on commercial vehicles. Each member state implements the directive through national legislation, but the core requirements are harmonised:
- HGVs (N2/N3): Limited to 90 km/h
- Buses/coaches (M3): Limited to 100 km/h
- Type-approval: ECE R89
Intelligent Speed Assistance (ISA) — EU 2019/2144
The EU General Safety Regulation (EU 2019/2144) introduced Intelligent Speed Assistance (ISA) as a mandatory requirement for all new vehicle type-approvals from July 2022, and for all new vehicles sold from July 2024.
ISA uses GPS data, camera-based sign recognition, or map databases to warn drivers when they exceed the posted speed limit. Important distinctions:
- ISA is not a replacement for R89 speed limiters. ISA warns or gently intervenes; R89 speed limiters enforce a hard maximum speed
- Both systems coexist. A new truck must have ISA (warns about posted limits) AND an R89 speed limiter (hard cap at 90 km/h)
- ISA can be overridden by the driver. R89 speed limiters cannot be overridden

Germany

Do I need a speed limiter on a van?
In the UK and EU, speed limiters are only legally required on vehicles over 3.5 tonnes and buses with 8+ seats. However, many fleet operators voluntarily fit speed limiters to vans for fuel savings, insurance reductions, and duty-of-care compliance.
Can I fit a speed limiter myself?
While self-installation is technically possible with some products, we strongly recommend professional installation by a qualified technician. How often does a speed limiter need recalibrating?
There is no fixed recalibration interval in UK law. However, the speed limiter should be checked during annual MOT/plating tests. What happens if my speed limiter fails an inspection?
