The Scale of the Problem

Work-related road risk is the single largest category of workplace fatality in the United Kingdom. Approximately one third of all road traffic collisions involve a vehicle being driven for work purposes. In any given year, this translates to hundreds of deaths and tens of thousands of serious injuries — a toll that vastly exceeds that of any other workplace hazard.

Despite this, work-related road safety (WRRS) has historically received less systematic attention than other occupational hazards. It does not occur in a factory or on a construction site. It happens on public roads, in conditions that vary constantly, and involves a vehicle that most people drive socially as well as professionally. This familiarity breeds a degree of complacency — in both drivers and employers — that the statistics do not support.

The Health and Safety Executive has been clear: driving at work is a work activity, subject to the same legal framework and the same employer obligations as any other hazardous task.

HSE Guidance: Driving at Work (INDG382)

The primary HSE guidance document for employers is INDG382: Driving at work — Managing work-related road safety. It applies to all employees who drive as part of their work, including those who:

  • Drive company vehicles (owned or leased)
  • Use their own vehicles for work journeys (grey fleet)
  • Drive between sites, to clients, or to deliveries

The guidance is explicit: the fact that a journey takes place on a public road does not make it exempt from health and safety law. Employers have the same duty to manage road risk as they have to manage any other workplace hazard.

INDG382 frames this around three areas of management:

The driver — competence, health, licence status, working hours, fatigue management.

The vehicle — roadworthiness, maintenance, suitability for the task, safety features.

The journey — route planning, scheduling, time pressure, communication requirements.

Speed management features prominently across all three. Driver speeding is a behaviour risk. Vehicle speed limiters are a technical control applied to the vehicle. Journey scheduling that creates time pressure, and therefore encourages speeding, is an organisational risk.

MORR: Managing Occupational Road Risk

The MORR (Managing Occupational Road Risk) framework, developed by the Royal Society for the Prevention of Accidents (RoSPA) and widely referenced by HSE, provides a structured approach to assessing and managing work-related road risk. Its structure mirrors the general HSE approach to occupational risk management:

  1. Policy — a clear written commitment from senior management to WRRS
  2. Risk assessment — identifying hazards, evaluating likelihood and severity
  3. Procedures and standards — documented rules for drivers and vehicles
  4. Training and awareness — ensuring drivers are competent and informed
  5. Monitoring and review — measuring outcomes and adjusting controls

Speed management sits at the intersection of risk assessment (speeding is a primary hazard), procedures (speed limits and limiter policies), and monitoring (telematics-based speed compliance tracking).

Within the MORR framework, a speed limiter is classified as a technical control — a measure applied to the vehicle that reduces risk regardless of individual driver behaviour. Technical controls rank above administrative controls (policies, training) in the hierarchy of risk management, because they do not depend on human compliance to be effective.

This distinction matters for HSE inspectors and, in the event of an incident, for prosecutors. A fleet that has relied solely on training and policy to manage speeding has taken administrative controls. A fleet that has fitted speed limiters has taken technical controls. The latter represents a more robust and defensible safety management position.

Employer Obligations Under HSWA 1974

The Health and Safety at Work etc. Act 1974 requires employers to ensure, so far as is reasonably practicable, the health, safety, and welfare of all employees at work. The Management of Health and Safety at Work Regulations 1999 require employers to conduct suitable and sufficient risk assessments and implement appropriate controls.

These obligations apply in full to driving at work. Specifically:

  • Employers must assess the risk of driving activities, including the risk of speeding
  • Employers must implement controls proportionate to that risk
  • Employers must monitor compliance with those controls
  • Employers must review and update their risk management as circumstances change

For fleet operators, this creates a clear mandate to consider speed limiters as part of the risk assessment process. Where a speed limiter is a reasonably practicable control — and for most commercial vehicles, it self-evidently is — the failure to fit one may be treated as a failure to fulfil the employer’s statutory duty.

Grey fleet (employees using their own vehicles for work) presents a specific challenge. Employers cannot mandate technical modifications to privately owned vehicles. However, they can and should address grey fleet speed risk through vehicle approval criteria, mileage allowance conditions, and in some cases by replacing grey fleet usage with company vehicles that can be properly equipped.
