Before You Start: Audit Scope and Frequency

Which vehicles require speed limiters?

Under UK Road Vehicles (Construction and Use) Regulations:

  • Goods vehicles with a maximum authorised mass (MAM) over 3.5 tonnes must have a speed limiter set to 90 km/h (56 mph)
  • Coaches and buses (M2/M3 vehicles with more than 8 passenger seats) must have a speed limiter set to 100 km/h (62 mph)

Confirm that your audit scope includes every vehicle in these categories, regardless of whether the vehicle is owned, leased, or on hire.

Recommended audit frequency:

  • Full compliance audit: annually as a minimum
  • Documentation check: quarterly
  • Post-servicing check: after any vehicle service that involves drivetrain, engine management, or electrical work

SECTION 1: Documentation Checklist

Documentation is the first thing a DVSA inspector will request. Ensure the following records are current, accurate, and retrievable for every qualifying vehicle.

Per-Vehicle Documentation

  • ECE R89 type-approval certificate — for the specific speed limiter device fitted to this vehicle. The certificate must confirm the device is approved for this vehicle class (N2/N3/M2/M3).
  • Installation record — signed by the installing engineer, including: vehicle registration, VIN, device make and model, device serial number, set speed, installation date, and installer identifier.
  • Most recent calibration/inspection record — dated within the last 12 months (or within the period specified by your maintenance contract).
  • Tamper event log — record of any tamper alerts generated since the last inspection, including date, time, and outcome of investigation.
  • Service history notes — any record of work carried out on the vehicle that may have affected the speed limiter (e.g., ECU remapping, tyre size changes, gearbox work).

Fleet-Level Documentation

  • Fleet register listing all vehicles subject to speed limiter requirement, with current compliance status for each.
  • Maintenance contract documentation confirming the contracted service schedule and SLA terms.
  • Supplier contact details and escalation path for fault reporting.
  • Internal speed limiter policy document (if applicable), including fleet-specific speed limits and any additional requirements beyond the legal minimum.

SECTION 2: Physical Inspection Checklist

A physical inspection should be carried out on each vehicle, either by your own qualified staff or by your speed limiter supplier as part of a scheduled maintenance visit.

External Inspection

  • Speed limiter unit is securely mounted and shows no signs of physical damage.
  • All tamper-evident seals are intact and show no signs of interference.
  • Wiring harness is routed correctly, secured, and shows no signs of chafing, cuts, or unauthorised modification.
  • No evidence of bridging wires, bypass switches, or other unauthorised additions to the speed limiter wiring.
  • Speed limiter indicator lamp (if fitted to dashboard) is present and operational.

Operational Check

  • Confirm speed limiter is active — carry out a brief operational check using approved method (road test to set speed, or workshop test equipment).
  • Confirm the device cuts engine power at the correct set speed within the permitted tolerance (±1 km/h).
  • For CAN bus-integrated systems: confirm the speed limiter is reading vehicle speed correctly from the bus (no fault codes).
  • For Drive-By-Wire systems: confirm throttle response is correctly intercepted at the set speed.

Post-Service Check (Where Applicable)

Following any vehicle service involving the engine, drivetrain, ECU, tyres, or electrical systems:

  • Confirm speed limiter wiring has not been disconnected during the service.
  • Confirm tamper seals are still intact (if disturbed, re-seal and document).
  • Carry out operational check to confirm set speed is still accurate.
  • Note in the service record that the speed limiter was checked post-service.

SECTION 3: Data and Telematics Checklist

  • Confirm that firmware is current on all devices (check against supplier’s current release version).

Reporting

  • Generate and archive the monthly compliance reports for the audit period.
  • Confirm data retention settings comply with your data management policy and any relevant GDPR considerations.

SECTION 4: DVSA Inspection Preparation Checklist

  • That the device fitted is type-approved to ECE R89 for the vehicle class
  • That the set speed is correct (90 km/h for HGVs, 100 km/h for coaches)

  • That there is no evidence of bypass or modification

If a Non-Compliance is Found

If your internal audit identifies a non-compliance issue before an external inspection:

  1. Remove the vehicle from service if the speed limiter is inoperative (do not operate on public roads without a functioning speed limiter).
  2. Report the fault to your speed limiter supplier immediately and request emergency attendance.
  3. Document the identification of the fault, the date it was found, and all remediation steps taken.
  4. Do not return the vehicle to service until a calibrated, functioning speed limiter has been reinstated and documented.
