HGV Speed Limiter Law: What Operators Must Know

If you hold an operator’s licence and run goods vehicles over 3.5 tonnes, speed limiter compliance is not optional — it is a legal requirement that directly affects your ability to operate. This guide covers everything HGV operators need to know about speed limiter law in the UK.

The Legal Requirement

Under The Road Vehicles (Construction and Use) Regulations 1986 (Regulation 36A), all goods vehicles with a maximum gross vehicle weight exceeding 3.5 tonnes must be fitted with a speed limitation device. The device must prevent the vehicle from exceeding 56mph (90 km/h).

This regulation was introduced in the UK on 1 August 1992 and applies to all goods vehicles first registered on or after 1 January 1988. In practical terms, every HGV on UK roads today is subject to this requirement.

Technical Requirements

The speed limiter must meet all of the following requirements:

Type-approval: The device must hold EU/ECE Regulation 89 (R89) type-approval. This is the international standard for speed limitation devices on motor vehicles. All AutoKontrol speed limiters carry EU/ECE R89 approval.

Speed setting: The limiter must be set so the vehicle cannot exceed 56mph (90 km/h) on level ground. DVSA allows a tolerance of +/- 5 km/h during testing, meaning the vehicle should not exceed 95 km/h under test conditions.

Tamper evidence: The unit must be sealed with tamper-evident seals. If the seals are broken, it is assumed the device has been tampered with until proven otherwise.

Speed limiter plate: A plate must be affixed to the vehicle (typically in the cab, near the driver) showing:

• The set speed in km/h
• The name and address of the speed limiter installer
• The date of calibration
• The speed limiter manufacturer and type

Maintenance: The speed limiter must be maintained in proper working order at all times. It is the operator’s responsibility to ensure ongoing compliance.

DVSA Enforcement in Practice

DVSA officers conduct speed limiter checks in three contexts:

Roadside Inspections

DVSA examiners stop HGVs at the roadside and check speed limiter compliance as part of vehicle condition checks. They look for the speed limiter plate, check tamper seals, and may use a roller brake tester to verify that the vehicle’s speed is actually limited.

Annual Test

During the annual HGV test (the heavy vehicle equivalent of an MOT), the speed limiter is tested on a rolling road. If the vehicle exceeds the set speed, it will fail the test.

Operator Premises Visits

DVSA can visit operator premises to inspect maintenance records. They will expect to see speed limiter documentation, including installation certificates, calibration records, and evidence of periodic checks.

Consequences of Non-Compliance

The penalties for HGV speed limiter non-compliance can be severe:

Immediate prohibition: The vehicle is removed from service until the speed limiter is repaired or fitted. For an operator running to tight schedules, losing a vehicle can cause significant disruption.

Fixed penalty: Up to GBP 300 per vehicle, per offence.

Prosecution: For serious offences (deliberate tampering, systematic non-compliance), prosecution in a magistrates’ court can result in fines up to GBP 5,000.

Traffic Commissioner action: This is the most serious risk. Speed limiter failures are reported to the Traffic Commissioner for the operator’s traffic area. The Commissioner may call the operator to a public inquiry. Possible outcomes include:

• Formal warning
• Curtailment of the operator’s licence (reduction in authorised vehicle numbers)
• Suspension of the operator’s licence (all vehicles must stop operating for a period)
• Revocation of the operator’s licence (permanent loss of the right to operate)

A single speed limiter failure may not trigger a public inquiry on its own. But when combined with other maintenance deficiencies, or when there is evidence of systematic non-compliance, the consequences can be career-ending for the operator.

Compliance Checklist for HGV Operators

Use this checklist to ensure your fleet is fully compliant:

1. Every vehicle over 3.5 tonnes GVW has a working, EU/ECE R89 type-approved speed limiter
2. Speed limiter plates are present, legible, and correctly completed on every vehicle
3. Tamper-evident seals are intact on every vehicle (check during daily walkaround)
4. Calibration records are kept for every vehicle and available for inspection
5. Speed limiters are included in your planned maintenance schedule
6. Drivers are trained to report any suspected speed limiter fault immediately
7. Your transport manager is aware of speed limiter compliance requirements
8. You have a relationship with an approved speed limiter installer for repairs and recalibration

Common Compliance Mistakes

• Missing speed limiter plates: Often lost during cab refurbishment or cleaning. Replace immediately.
• Broken tamper seals: Can be accidentally broken during unrelated vehicle repairs. Have the speed limiter resealed by an approved installer.
• Out-of-calibration devices: Speed limiters should be checked periodically, especially after gearbox or axle ratio changes that affect the speed signal.
• Documentation gaps: Operators cannot produce installation certificates or calibration records when DVSA asks. Maintain a central filing system.
• Second-hand vehicles: Purchasing used HGVs without checking speed limiter documentation. Always verify compliance before putting an acquired vehicle into service.
